Guest access and supervision
Guest access is subject to capacity, advance registration, payment of applicable fees, signed waivers, current restrictions, and Club Rules. No person under 18 may sponsor, register, or bring a guest. The member is responsible for the guest's conduct and must accompany the guest when required. A guest age 15 or younger must be actively supervised by an eligible adult under the Club Rules. Club 333 may deny or revoke guest access for lawful safety, conduct, capacity, or operational reasons.
Health, safety, and personal property
The guest will use reasonable judgment, follow posted rules and staff direction, use only amenities they can safely use, stop if they feel unwell or unsafe, and promptly report an incident or unsafe condition. Staff do not provide medical advice, and lifeguard or medical supervision is not guaranteed unless specifically posted. Each person remains responsible for personal property. The Protected Parties are not insurers and are not responsible for loss caused by another member, guest, or third party outside their reasonable control. This limitation does not apply to a Protected Party's negligence or other nonwaivable liability.
Assumption of inherent risks
Physical exercise, swimming, sports, classes, equipment, wet surfaces, shared facilities, and contact with others involve inherent risks, including falls, collisions, strains, illness, and injury. To the extent permitted by law, the member and guest voluntarily assume risks arising solely from those inherent risks or their own misuse, rule violation, or failure to use reasonable care. This form does not release any Protected Party from negligence, gross negligence, reckless or intentional conduct, statutory liability, or any obligation that cannot lawfully be waived.
Member responsibility and limited indemnity
The member is responsible for reasonable documented repair costs caused by the member's or guest's intentional misconduct, misuse, or negligence; ordinary wear is excluded. To the maximum extent permitted by law, the member agrees to defend, indemnify, and hold harmless the Protected Parties from damages, losses, claims, costs, and expenses arising from the member's or guest's negligent, intentional, or willful misconduct, fraud, unlawful conduct, misuse of the Club, or breach of these terms. This does not require indemnity for a Protected Party's gross negligence, willful misconduct, or violation of law.
Privacy, records, and governing terms
Information may be used for access, safety, administration, and recordkeeping and may be shared when reasonably necessary and lawful with Building Management, access-control and service providers, instructors, insurers, professional advisers, and authorities. New York law governs. If a provision is invalid, it is severed or enforced to the maximum lawful extent without affecting the remainder. Electronic execution, check-box assent, and retained electronic records are permitted.
